1. Acceptance of These Terms
These Terms & Conditions (“Terms”) govern your use of kothomigo.com (the “Platform”), operated by Homigo Ltd, a company registered in Mauritius (Business Registration Number: C26236133), registered address 3 Route Tranquille, Vacoas, Mauritius.
By creating an account, browsing listings, making a booking, or listing a property on Homigo, you agree to these Terms. If you do not agree, please do not use the Platform.
2. About Homigo
Homigo is an online marketplace connecting guests with local hosts offering villas, campments, apartments, lodges, and studios across Mauritius. Homigo is not the owner or operator of any listed property. We provide the platform that allows hosts to advertise their properties and guests to discover and book them. The actual accommodation contract is between the guest and the host.
3. Account Registration
To book a stay or list a property, you must create an account and provide accurate, current information (including a valid email address and phone number). You are responsible for keeping your login details secure and for all activity that occurs under your account.
You must be at least 18 years old to create an account or make a booking on Homigo.
4. For Guests
Making a booking. When you submit a booking on Homigo, you are sending a booking request to the host. A booking is only confirmed once accepted by the host (or automatically confirmed, depending on the listing’s settings).
Payment. At this time, Homigo does not process payments online. Payment arrangements for confirmed bookings are made directly between the guest and the host. Homigo will introduce secure online payment (via MIPS) in the future; these Terms will be updated accordingly once that feature is live.
Cancellations & Refunds.
- Cancelling more than 24 hours before check-in entitles you to a 100% refund.
- Cancelling within 24 hours of check-in entitles you to an 80% refund.
- If a host cancels a confirmed booking, the guest is entitled to a 100% refund. Host-initiated cancellations are reviewed by Homigo before any refund is issued.
- Refunds, once approved, are processed within 7 days.
Since online payment is not yet active on the Platform, any refund under this section will be coordinated directly between the guest and host, with Homigo available to assist in case of a dispute.
Guest conduct. Guests are expected to treat host properties with respect, follow any house rules communicated by the host, and provide accurate information (including number of guests and purpose of stay) when booking.
5. For Hosts
Listing accuracy. Hosts are responsible for ensuring that all information in their listings (photos, descriptions, pricing, availability, and amenities) is accurate and kept up to date.
Legal compliance and licensing. Hosts are solely responsible for ensuring that their property and their rental activity comply with all applicable Mauritian laws, including but not limited to:
- Holding a valid Tourist Enterprise Licence (TEL) or Tourist Accommodation Certificate (TAC) issued by the Mauritius Tourism Authority, as required under the Tourism Authority Act 2006 for any accommodation rented for a period of less than 12 months;
- Registering their rental activity with the relevant authorities (including the Mauritius Revenue Authority) and declaring rental income as required by law;
- Collecting and remitting any applicable Tourist Fee or similar statutory charge; and
- Complying with any building, safety, health, or zoning requirements applicable to their property.
Homigo does not verify, and makes no representation as to, whether a host holds any required licence or is otherwise compliant with applicable law. By listing a property on Homigo, the host represents and warrants that they hold all licences and authorisations required to lawfully rent their property, and agrees to indemnify Homigo against any claim, fine, or liability arising from their failure to do so. Homigo reserves the right to request evidence of a valid licence at any time and to suspend or remove a listing if such evidence is not provided.
Content and intellectual property. Hosts retain ownership of the photos, videos, descriptions, and other content (“Content”) they upload to the Platform. By uploading Content, hosts grant Homigo a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that Content for the purpose of operating and promoting the Platform, including on Homigo’s website, social media accounts, and marketing materials. This licence continues while the listing remains active and for a reasonable period afterward for materials already published (e.g., past social media posts). Hosts confirm they have the right to upload the Content and that it does not infringe any third party’s rights. Hosts participating in any specific marketing programme (such as the Founding Hosts Program) may be subject to additional terms governing shared use of Content, set out separately for that programme.
Availability & bookings. Hosts are responsible for managing their calendar and honouring confirmed bookings. Repeated cancellations by a host may result in the listing being hidden or removed from the Platform.
Homigo’s rights. Homigo reserves the right to hide, suspend, or remove any listing that violates these Terms, contains inaccurate information, or is otherwise deemed unsuitable for the Platform, at our sole discretion.
Fees. Homigo does not currently charge hosts a commission or listing fee. Should Homigo introduce a commission or fee in the future, hosts will be notified in writing (by email or in-app notice) at least 30 days before the change takes effect, specifying the applicable rate, how it is calculated, and how and when it is charged. The new fee will not apply retroactively to bookings confirmed before the change takes effect.
6. Reviews
Guests may leave a review after completing a stay. Reviews must reflect genuine experiences. Homigo does not permit fake, incentivized, or misleading reviews. Hosts may reply publicly to reviews left on their listings. Homigo reserves the right to remove reviews that violate these Terms.
7. Prohibited Conduct
- Provide false or misleading information
- Attempt to circumvent the Platform to avoid fees (once applicable) or bypass safety measures
- Harass, threaten, or discriminate against other users
- Use the Platform for any unlawful purpose
- Attempt to interfere with the security or proper functioning of the Platform
8. Limitation of Liability
Homigo acts as an intermediary connecting guests and hosts. To the fullest extent permitted by law, Homigo is not responsible for the condition, safety, or legality of any listed property, the conduct of any guest or host, or any loss, damage, or dispute arising from a booking made through the Platform.
9. Force Majeure
Neither Homigo nor a host will be liable for any failure or delay in performing their obligations under a booking (including honouring a confirmed reservation) where such failure or delay results from circumstances beyond their reasonable control, including but not limited to natural disasters, cyclones, extreme weather warnings issued by the Mauritius Meteorological Services, public health emergencies, government-imposed restrictions, or civil unrest. In such cases, guests and hosts are encouraged to agree on a rescheduled stay or an appropriate refund; Homigo may assist in facilitating this but is not obligated to guarantee a specific outcome.
10. Termination
Homigo reserves the right to suspend or terminate any account that violates these Terms, at our sole discretion, with or without prior notice.
11. Changes to These Terms
We may update these Terms from time to time, particularly as new features (such as online payments) become available. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of Mauritius, including the Electronic Transactions Act 2000, which gives legal recognition to electronic contracts, records, and signatures. By ticking a box or otherwise indicating your acceptance electronically on the Platform, you are entering into a legally binding agreement to the same extent as if you had signed a paper document. Any disputes arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts of Mauritius.
